Terms and conditions for Nutritional analysis - 4 x 30 mins

1. The Club.

The Club is "Elite Fitness & Leisure (Thornbury) Limited" and where mentioned refers to all staff and managment who represent The Club. The principle objective of The Club is to provide health and fitness facilities and services for Club members and their guests. The company has an appointed General Manager who is responsible for the operation of the club. "Russell Knight Personal Training LTD" is a seperate personal training business operating within The Club. Our company numbers are 05660179 AND 10184181 respectively.

2. Gym Membership.

a) All Memberships are subject to the rules and regulations of The Club, which are always in force.

b) Membership is personal to the member and is non-transferable and non-refundable unless explicitly agreed to in writing by the General Manager of Elite Fitness.

c) Membership entitles a member to full use of The Club’s facilities during opening hours. As a member, you pay for 70 operational hours a week on average per year. This can be increased or decreased at any time and the Management shall endeavour to give reasonable notice. Memberships are available to individuals of at least 12 years of age. The Management reserve the right to introduce other categories of membership.

d) On acceptance, the member will be issued a membership card - either a physical or virtual one via the Club App. You will need to use this to sign/swipe in each time you visit the gym. If you don’t have your card, you need to sign in at reception and sign out when you leave. If a membership card is lost or mislaid, the Management will issue a replacement card and reserve the right to charge a nominal fee.

e) All members shall pay an initial joining fee where applicable to the sum specified upon becoming a member of The Club which shall be due immediately upon the member being accepted as a member. Joining fees are subject to change without notice. Memberships may also increase or decrease at the discretion of the Management. The Club reserves the right to reject an application for any membership or service.

f) Membership is payable in advance either monthly via Standing Order/Direct Debit. Alternatively, you can pay up front for the duration of your membership of either 6, 12, 24 or 36 months. If you pay monthly you are entering an agreement to make the minimum amount of payments as stated on your contract - either 6 or 12 months.You can add your credit card to your membership via the Club App which will automatically make the due payments on your account at the agreed intervals. As a member it is your responsibility to discontinue the payments to us at the end of your minimum length membership term. The Club are unable to refund overpayments unless they are at the fault of the management. If you wish to cancel your membership you need to inform The Management with 30 days written notice before you cancel your payments to us.

g) The Monthly Rolling Deal offers you full flexibility. You need to pay the joining fee and set up your standing order/direct debit before commencement of your membership. You can cancel any time with 30 days' written notice to the Management or online via the Club App.

h) If you pay online your card details will be stored with those companies and not with Elite Fitness. We do not have access to your banking/card details if you use these methods.

i) Membership Holds - if you feel you need to put your plan on hold please contact a member of staff to discuss. In exceptional circumstances we may be able to put your membership on hold. You are still liable to complete your membership and all payments.

j) Appropriate clean clothing must be worn at all times in the Club (and during classes unless specifically otherwise advised by an instructor). Trainers/equivalent must be worn whilst using the equipment in the gymnasium. All Members and Guests are encouraged to take a small towel into the gymnasium when working out in order to wipe down the equipment out of courtesy for the next user – or use the paper towels provided.

k) In the interest of health and hygiene, all Club users must shower before using the sauna. Children under the age of 16 years are not permitted to use the sauna.

l) Members are not allowed to open/close any windows or doors without the consent of the member of staff on duty.

m) Members and their Guests use areas which are not supervised at their own risk and the Management accept no responsibility for any harm or injury to any Member or Guest unless caused by the negligence of the Management, employees or agents of the Club.

n) For security reasons, Members and Guests are asked to store personal belongings and valuables in the lockers provided. Leaving your belongings in the locker does not guarantee security and The Club accepts no responsibility for lost or stolen belongings. Lockers are provided on a daily basis only and items left overnight will be removed and retained at reception for a reasonable period of time appropriate to their value and will then be disposed of via local charity shops by the Management.

o) The Management may terminate the Membership of any Member:

i) Without notice and with immediate effect if the Member's conduct, whether or not such conduct is the subject of complaint by other members, is such that in the reasonable opinion of the Management, it may be injurious to the character of interests of the Club or if the Member commits a serious or repeated breach of these terms and conditions or of the rules of the Club as are from time to time in force.

iii) If any part of the initial Joining Fee, monthly membership fee or paid in full monies which are due and payable remains unpaid after the due date for payment or any lapses in membership, including monthly payments may result in the joining fee being charged on return.

p) The Club reserve the right to initiate Court proceedings if payment is late and remains unpaid after repeated attempts to solve the issue. Any cost in recovery will be in addition to your membership.

q) A member whose membership is terminated will forfeit all rights and privileges of Membership with immediate effect without claim for any refund of joining fee or any membership fees paid in advance and shall remain liable for any part of the initial joining fee that remains due and owing to the Company at the date of termination of Membership.

r) Members and Guests should use the equipment and facilities in accordance with the advice given by the Club staff and/or by notices suitably posted. Members and Guests shall not abuse the equipment or facilities of the Club and any damage to Club property shall be paid for by any Member or Guest who wilfully or negligently causes such damage.

s) No member or Guest shall bring intoxicating liquor or food onto the premises. Smoking is not permitted anywhere on the premises.

t) We have links with various local companies who have generous offers to you as an active member of Elite Fitness. When you join you will be issued with these vouchers, you can only use them whilst you are an active member with us and will be asked to provide proof of your membership to receive the discount.

u) We offer a referral scheme – if you introduce someone who joins on a 6 or 12 month deal paying monthly or in full you will be eligible to receive a month worth of your gym fees back as a reward. You must mention this at the point of your referral joning up, retrospective payments can't be made to members you may have introduced in the past.

3. Student Membership

a) We offer a discounted membership for students, you will need to show proof of your student status and tell us when you are due to graduate at the commencement of your membership.

b) You will need to pay the joining fee and first month of monies before you start using the gym. If you are just back from University/College for a month at Christmas/Easter/Summer Break you do not need to pay the joining fee. If you wish to stay a member for longer than one month you will need to pay the joining fee.

c) We offer complete flexibility and you are not held in a contract with us, you are abe to cancel your membership with us with 30 days written notice.

4. Corporate Memberships

a) We offer a discounted membership to selected local companies and their employees. We also offer our corporate deal to members of the following services: 999 services, NHS, Military, Navy, RAF. You need to mention this before commencement of your membership if you wish to apply for this membership, we cannot retrospectively refund any monies paid from alternative memberships that you may have with us.

b) To qualify, a company needs to have at least two employees wishing to take out a corporate membership with us. The joining fee still applies for every member.

c) We offer a corporate membership for players of Olveston United Football Club and Old Down Cricket Club. To apply for this membership you will need to prove your membership with either team. There is no joining fee for this membership with us.

d) We offer complete flexibility and you are not held in a contract with us, you are abe to cancel your membership with us with 30 days written notice.

5. MyPhysio Membership

a) We offer a one month deal for patients of MyPhysio returning to exercise. There is no joining fee associated with this one off membership. We offer an induction with this membership but not the regular services associated with a full membership with us. If you wish to continue to use the gym after this one month you will need to join on one of our regular memberships and pay the joining fee.

6. Guests.

a) Members may introduce Guests to the Club to use the facilities. The member shall ensure that their guest completes a Guest PARQ form and pays the appropriate Guest fee. Guests must always be accompanied by the Member introducing them who will be responsible for the Guests actions whilst on the Clubs premises.

b) Guests will have the same Membership privileges as the Member who is escorting them and will be subject to the same rules. It is the responsibility of the Member introducing the guest to ensure that their Guest complies with the rules of the Club.

c) The Management reserves the right to exclude or refuse entry to any guest from the Club without giving any reason for doing so.

d) We offer one week passes if you are just in the area for a short period – this can be used only once and at the discrestion of The Club. After the one week membership has expired, if you wish to continue using the facilities you will need to join on a regular membership and pay the joining fee.

7. Children (under 18)

a) Children aged 12-17 may join and use the facilities of the Club during permitted hours determined by the Management from time to time. Children (under 18) must have prior written consent from a parent/guardian who are responsible for their behaviour and covering any costs incurred.

b) The Management may specify certain programmes, classes and activities where children can and cannot participate without adult supervision.

c) The management reserve the right to make arrangements with local schools and other organisations to use the facilities at different times.

d) We offer a 'quid a kid' scheme where children aged 12-15 can use the facilities under the supervision of a parent or guardian. All normal rules apply.

8. Reservations/Appointments

a) When you join you will be offered an induction – this is the first step on our four step procedure to make sure you make the most of your gym membership. After your induction you can book in your Assessment and Programme, we will assess your fitness history and current health situation, form an appropriate and realistic programme tailored specifically for you. After this you can book in a Programme Run Through, where one of our trainers will run you through the programme that's been written for you. We then recommend you book in for a reassessment and new programme every couple of months. These services are all included in your membership providing you have paid for the joining fee. All reservations for services/programmes/classes/appointments may be made in advance via any of our contact details and in The Club App.

b) We ask for suitable notice where possible to cancel a reservation. If no notice is given, the Member who made the reservation will be subject to a nominal cancellation fee unless the booking can be rebooked at the discretion of the trainer the appointment was with.

c) The Management reserve the right to refuse to re-book a Member who cancels or fails to keep an appointment for services/programmes repeatedly.

9. Other

a) The Management reserve the right to use any individual or group photographs of Members/guests for press or promotional purposes. Where members or guests are in shot, every endeavour will be made to gain explicit consent to use their image.

b) The Management may from time to time wish to show potential Members or others around the Club and allow them to use the Club facilities on a trial basis and reserve the right to do so.

c) The Club's normal hours of operation/opening and hours in which any facilities are available to members are obtainable from the Club on request, they are also displayed on the front door of the gym and on the Club Website. The Management reserve the right to adjust the operational hours of the Club for the purpose of cleaning, decoration, repair, or for special events or holidays. The Management will endeavour to give reasonable notice of any change in operational hours.

d) The Management reserve the right to hold private functions in parts of the Club from time to time and will advise members in advance on the Club notice board of any changes in opening hours or alterations to the Club schedule to accommodate such functions.

e) The failure of the Management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.

f) Neither the company, nor its employees or agents shall be liable for any loss, damage, or theft of any property belonging to, or brought onto the Club premises by the Member or any guest of the Member, occurring on the Club premises unless caused by negligence of the Management, employees or agents of the Club.

g) Neither the Club, nor its employees or agents of the Club shall be responsible for any death, personal injury, or illness occurring on the premises or as a result of the use of the facilities and/or equipment provided by the Club, except to the extent that such death, personal injury or illness arises from a negligent act or omission of the Club or its employees or agents.

10. GDPR/Privacy Policy

a) To obtain a membership you will need to give us certain personal data. This data is used to help give you the best possible experience. We store your phone, email and address details so that we can contact to regarding your membership with us and to tailor promotional material to you. We store your date of birth so that we can assess your age to ensure you are able to use certain aspects of the gym. We store data such as your visits and spend with us to help us tailor our services to you.

b) If you cancel your membership with us, we will delete all stored information that identifies you at your request.

c) If any of your contact information changes, we request that you let us know in writing or update via the Club App so that we can continue to reach you regarding your membership.

d) If you have personal training, your phone number and email will be passed to your trainer so they can contact you directly to arrange/rearrange sessions. If such time comes that you stop seeing the trainer, they will delete your number and email at your request.

e) When you join, we will take your photograph so that we can identify you on entry to the club - this photo is stored on our secure computer and within your account online.

f) All Members must notify the Management, employee or agent of any change of address/contact details so that we can contact you regarding your membership.

11. VAT

a) All Gym memberships with Elite Fitness are subject to VAT at 20% - your bill/receipt/invoice will say if your product is VAT inclusive or excluding.

b) Our VAT number is 310722059

12. Sun Bed

If you have had any of the following complaints it is advised that you consult your GP prior to treatment.

Heart/Chest complaints, High Blood Pressure, Kidney Disorders, Epilepsy, Diabetes, Migraines, Back Problems, Moles, Eye Infections, Asthma, Athletes Foot, Cold Sores, Dermatological Problems, Radiation Treatment, Pregnancy, Taking Prescribed Medication, Family History of Skin Cancer

A UVA tanning system should be treated with the same caution as natural sunlight. A suntan should always be built gradually, particularly with sensitive skin. Never repeat UVA tanning treatment if any signs of redness remain from previous tanning. GOGGLES MUST BE WORN AT ALL TIMES during exposure. Contact lenses should be removed. Avoid looking directly at the tubes/ lamps whilst in the sun bed. Persons with sensitive skin or no existing tan should restrict their first few sessions to a maximum of 3-6 minutes. It is important that the skin is thoroughly clean before tanning. The HSE recommend that you should not have more than 20 sessions per year, should allow 24 hours between sessions and not sunbathe on the same day as a tanning session or when there is still redness/ soreness of a tanning session. All traces of perfume, cologne, after-shave, and make up should be removed. Read the safe tanning guide before commencing treatment.

You agree to have read the aforementioned information, understood the content and context and you're satisfied that you are suitable for UVA treatment.

We require you to advise us of any changes in your medical circumstances immediately. Sessions must be used within 12 months.

13. Personal Training

a) Personal Training is provided by Russell Knight Personal Training LTD. Each PT session is for 60 minutes inclusive of administration time, from the scheduled start time unless agreed otherwise.
b) You are asked to give 8 hours' notice to cancel/reschedule a session to ensure it's not forfeited.
c) You have the length of your membership term to fit in all your sessions. You can carry-over sessions that have not been scheduled into any other active membership, enabling you to keep all the sessions that you have paid for. You cannot use PT Sessions without an active membership. We aim to be as flexible as possible to help you fit in all your sessions.
d) Each session is a one-on-one session unless you join up for the 'Train With a Friend' option.
e) If you pay for a Personal Training Membership to train with a friend this includes gym membership for both of you for the month and shared one hour PT sessions.
f) If one of you fails to attend a shared PT Session, the Session will still be marked off as a shared session taken from your credits.
g) You can purchase additional sessions to use during your Membership term.
h) The packages are not set in stone and can be altered to accommodate your specific needs - please get in touch if you would like to build a bespoke package for you.

14. Nutritional Package

a) We offer four 30 minute sessions with one of our personal trainers. This includes analysis of your food diary & advice on nutrition for optimal health.

b) On payment you will be given a food diary to fill out and bring to your first nutrition session. During your first nutrition session your trainer will analyse your food diary and give advice on nutrition for optimal health. In your 3 subsequent follow up sessions your trainer will monitor your progress and refine your consumption to maximise results.

c) If you don't have the time to have the 3 subsequent follow up sessions, this process can be completed via texts directly with your trainer instead of meeting up – there is no extra charge for this service and there isn't a limit to the number of texts to a reasonable amount.

15. Physical Condition of Member.

a) The Member warrants that he/she is in good physical condition and knows of no medical or other reason why they are not capable of engaging in active or passive exercise and that such exercise would not be detrimental to his/her health, safety comfort or physical condition.

b) The Member shall not use any Club facilities whilst suffering from any infections or contagious illness, disease or other ailment such as open cuts, abrasions, sores or minor infections where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other Members.

c) If you cannot use your membership due to a medical situation that has arisen, we are able to place your membership on hold at the discretion of the management. This cannot be arranged retrospectively and refunds are not available for lack of use.

Physical Activity Readiness Questions:

If you answer yes to any of the following questions you agree to inform a member of staff and talk to your doctor before proceeding.

Has your doctor ever said you have a heart condition and you should only do physical activity recommended by a doctor?

Do you feel any pain in your chest when you do physical activity?

In the past month, have you had chest pain when you were not doing physical activity?

Do you lose your balance because of dizziness or do you ever lose consciousness?

Do you suffer from asthma or breathing difficulties?

Do you suffer from diabetes or epilepsy?

Do you have a bone or joint problem that could be made worse by a change in your physical activity?

Is your doctor currently prescribing drugs (e.g. water pills) for your blood pressure or heart condition?

Are you pre/post natal?

Do you know of any other reason why you should not perform physical activity or training?

If you have answered 'yes' to one or more questions, talk with your doctor BEFORE you become more physically active. Tell your doctor about what you intend to start and follow your doctor’s advice.

If you answered NO to all the questions you can be reasonably sure that you can become more active but begin slowly and build up the activity gradually.

If you have been feeling unwell or may be pregnant delay becoming more physically active if you are not feeling well because of a temporary illness, such as a cold or a fever.

If you are or may be pregnant, talk to your doctor before you start becoming more physically active.

If your health changes so that you change any of your answers above tell a member of staff and ask whether you should change your physical activity plan.


You agree that you understand a physical fitness program includes exercises to build the cardiorespiratory system, the musculoskeletal system, and to improve body composition and that this has many benefits. Although, the reaction of the heart, lungs and blood vessel system to exercise cannot always be predicted with accuracy. You understand that the fitness tests and training are voluntary, and that you're free to stop the tests or training at any point. You understand that Elite Ftiness, Russell Knight or any Personal Trainers working for Elite Fitness or Russell Knight shall not be liable for any damages arising from personal injuries sustained during training, unless caused by negligence on the part of the trainer. You understand that you are using all equipment during the workout at your own risk.

You hereby acknowledge that you have reviewed and agree to the above conditions. Any questions you had concerning these conditions have been answered to your satisfaction. You confirm that the details provided on joining are correct and agree to abide by the terms and conditions of the club, a copy of which is on the notice board in the gym.
